Terms of Service

1. Acceptance of Terms
By accessing or using the Call HTX website, mobile application, or any related services (collectively, the “Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you may not access or use the Platform.
These Terms constitute a legally binding agreement between you and Conflenti Media LLC (“Call HTX,” “we,” “us,” or “our”). We reserve the right to update or modify these Terms at any time, and your continued use of the Platform following any changes constitutes acceptance of the revised Terms.
2. Description of Service
Call HTX is a standards-based membership network that facilitates introductions between homeowners in the Houston, Texas metropolitan area and independent, state-license-verified tradespeople, including but not limited to plumbers, electricians, and HVAC technicians.
Call HTX is not a home services provider. We do not perform, supervise, or guarantee any work carried out by technicians listed on the Platform. We serve solely as an intermediary that facilitates the connection between homeowners seeking services and independent tradespeople offering those services. All service agreements, pricing, scheduling, and work quality are strictly between the homeowner and the technician.
3. User Accounts
Technicians
Technicians must submit an application and be approved by Call HTX before being listed on the Platform. Approval is at our sole discretion. We may verify licenses, insurance, and other credentials as part of the application review process. Technicians must create and maintain an account with accurate, current information.
Homeowners
Homeowners may search for and contact technicians on the Platform without creating an account or logging in. Account creation is entirely optional and is only required for certain features, such as leaving reviews. Homeowners who create accounts are responsible for maintaining the confidentiality of their login credentials.
4. Technician Obligations
By registering as a technician on Call HTX, you agree to:
- Provide accurate and up-to-date information in your profile, including your business name, contact details, service area, and pricing.
- Maintain all required licenses, certifications, and insurance as mandated by the State of Texas and applicable local jurisdictions. You must promptly notify Call HTX of any changes to your licensure or insurance status.
- Pay all applicable subscription fees in a timely manner as described in Section 7.
- Conduct yourself professionally in all interactions with homeowners, including responding to inquiries promptly, arriving on time, providing honest assessments, and performing work to a high standard.
- Refrain from engaging in deceptive, fraudulent, or unethical business practices, including unnecessary upselling, misrepresenting the scope of needed repairs, or performing substandard work.
- Comply with all applicable federal, state, and local laws and regulations.
5. Homeowner Responsibilities
By using the Platform as a homeowner, you agree to:
- Provide accurate information when contacting technicians, including the nature of the issue and your location.
- Treat technicians with respect and professionalism in all communications and in-person interactions.
- Understand that Call HTX does not employ, supervise, or control the technicians listed on the Platform. Any agreement for services is between you and the technician directly.
- Exercise your own judgment and due diligence when selecting and hiring a technician, including verifying credentials and obtaining estimates before work begins.
- Submit honest, accurate, and fair reviews if you choose to leave feedback about a technician.
6. SMS and Call Communications
Call HTX uses a call and text forwarding system to connect homeowners with technicians. When a homeowner contacts a technician through the Platform, the call or text message is forwarded to the technician's registered phone number.
Technician Consent
By subscribing to Call HTX and listing your profile on the Platform, you expressly consent to receiving forwarded phone calls and SMS text messages from homeowners as part of the service. The frequency of messages and calls varies based on homeowner inquiries and your availability status.

Message frequency varies based on homeowner inquiries. You may opt out of SMS communications at any time by replying STOP to any message. Opting out of SMS may limit the functionality of the Platform and your ability to receive leads. Standard message and data rates from your wireless carrier may apply.
Homeowner Communications
When you contact a technician through Call HTX, your call or message is forwarded through our system. You acknowledge that your phone number may be visible to the technician you are contacting. Standard message and data rates from your wireless carrier may apply.
7. Payments and Subscriptions
Technicians pay a flat monthly subscription fee to be listed on the Platform. There are no per-lead fees, no percentage-based commissions, and no additional charges for homeowner inquiries. Homeowners use the Platform entirely free of charge.
- All payments are processed securely through Stripe, our third-party payment processor. By subscribing, you agree to Stripe's Terms of Service.
- Subscriptions automatically renew on a monthly basis unless cancelled. You may cancel your subscription at any time through your technician dashboard.
- Cancellation takes effect at the end of your current billing cycle. You will retain access to the Platform until the end of the period you have already paid for.
- Subscription fees are non-refundable unless otherwise required by applicable law or at Call HTX's sole discretion.
- Call HTX reserves the right to change subscription pricing with at least 30 days' notice. Continued use of the Platform after a price change constitutes acceptance of the new pricing.
8. Content and Reviews
Users may submit content to the Platform, including but not limited to profile information, photos, reviews, and ratings (collectively, “User Content”). By submitting User Content, you grant Call HTX a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, modify, and distribute such content in connection with the operation of the Platform.
You represent and warrant that:
- You own or have the necessary rights to submit the User Content.
- Your User Content is accurate, not misleading, and does not violate any applicable law or the rights of any third party.
- Your reviews are based on genuine, firsthand experiences.
Call HTX reserves the right, but is not obligated, to review, monitor, edit, or remove any User Content at our sole discretion, including content that we determine to be fraudulent, abusive, defamatory, or otherwise in violation of these Terms.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Call HTX and its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising out of or related to your use of or inability to use the Platform.
Call HTX connects homeowners with independent technicians. We do not guarantee the quality, safety, legality, or timeliness of any services performed by technicians. We are not responsible for any property damage, personal injury, or financial loss resulting from services arranged through the Platform.
In no event shall Call HTX's total aggregate liability to you for all claims arising out of or related to these Terms or the Platform exceed the total amount you have paid to Call HTX in the twelve (12) months preceding the claim.
10. Indemnification
You agree to indemnify, defend, and hold harmless Call HTX, Conflenti Media LLC, and their respective officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:
- Your use of or access to the Platform.
- Your violation of these Terms.
- Your violation of any applicable law or the rights of any third party.
- Any services you provide or receive through the Platform.
- Any User Content you submit to the Platform.
11. Disclaimers
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Call HTX does not warrant that: (a) the Platform will be uninterrupted, timely, secure, or error-free; (b) any information provided on the Platform, including technician profiles and reviews, is accurate, reliable, or complete; or (c) any defects in the Platform will be corrected.
Call HTX does not endorse, warrant, or guarantee the work, services, credentials, or conduct of any technician listed on the Platform. While we make reasonable efforts to verify technician credentials during the application process, we make no representations or warranties regarding their qualifications, reliability, performance, or compliance with applicable laws. Homeowners are solely responsible for evaluating and selecting technicians.
12. Termination
Call HTX reserves the right to suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:
- Violation of these Terms.
- Fraudulent, abusive, or illegal activity.
- Failure to maintain valid licenses, certifications, or insurance (technicians).
- Repeated complaints from homeowners or other users regarding conduct or service quality.
- Non-payment of subscription fees (technicians).
- Any conduct that Call HTX determines, in its sole discretion, is harmful to the Platform, its users, or the Call HTX brand.
Upon termination, your right to use the Platform will immediately cease. Sections of these Terms that by their nature should survive termination shall remain in effect, including but not limited to Sections 9, 10, 11, 13, 14, 15, and 18.
13. Independent Contractor Relationship
Technicians listed on Call HTX are independent contractors and are not employees, agents, or representatives of Call HTX or Conflenti Media LLC. Call HTX does not direct, control, or supervise the work performed by any technician. Technicians set their own rates, hours, methods, and business practices. Nothing in these Terms or on the Platform shall be construed as creating an employment, partnership, joint venture, or agency relationship between Call HTX and any technician.
14. Dispute Resolution
Any dispute arising out of or relating to these Terms or the Platform shall first be attempted to be resolved through good-faith negotiation. If the dispute cannot be resolved informally within thirty (30) days, either party may pursue binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, with the arbitration conducted in Harris County, Texas.
Class Action Waiver: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Disputes between homeowners and technicians regarding the quality, pricing, or performance of services are strictly between those parties. Call HTX is not a party to any service agreement and has no obligation to mediate, arbitrate, or resolve disputes between homeowners and technicians.
15. Verification Limitations
Call HTX verifies technician license information against publicly available state records (such as the Texas Department of Licensing and Regulation and the Texas State Board of Plumbing Examiners) at the time of onboarding. However, Call HTX is not a regulatory body and does not guarantee the ongoing validity, accuracy, or completeness of any license, certification, or insurance information displayed on the Platform.
Homeowners are encouraged to independently verify license status through the State of Texas and to confirm insurance coverage directly with the technician before authorizing any work. Call HTX makes no warranty or representation regarding workmanship, safety, or compliance with applicable codes and standards.
16. No Lead or Inquiry Guarantee
Call HTX does not guarantee any minimum number of leads, inquiries, calls, or jobs for technicians. The volume and frequency of homeowner inquiries depend on factors outside of Call HTX's control, including but not limited to market demand, geographic coverage, seasonality, and the technician's own profile completeness and availability settings.
Subscription fees are for access to the Platform and its features, not for a guaranteed volume of business. Technicians acknowledge that results may vary and that Call HTX bears no liability for business outcomes.
17. AI and Automated Tools
Call HTX may use artificial intelligence, machine learning, or other automated tools to improve the Platform, including but not limited to search ranking, content recommendations, and internal operations. These tools are used to enhance the user experience and do not make decisions regarding technician approval, removal, or service quality on their own.
AI-generated or AI-assisted content on the Platform (such as emergency guides or search suggestions) is provided for informational purposes only and does not constitute professional advice. Users should always exercise their own judgment and consult qualified professionals for specific issues.
18. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising out of or related to these Terms or the Platform shall be resolved exclusively in the state or federal courts located in Harris County, Texas. You consent to the personal jurisdiction and venue of such courts.
19. Changes to Terms
Call HTX reserves the right to modify these Terms at any time. We will notify users of material changes by posting the updated Terms on the Platform and updating the “Effective Date” at the top of this page. For technicians with active subscriptions, we may also provide notice via email.
Your continued use of the Platform after any changes to these Terms constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Platform and, if applicable, cancel your subscription.
